TERMS AND CONDITIONS - VELOSOPHY BIKE COMPETITION
Please read the following Terms and Conditions carefully before entering this Competition. By entering the competition, you accept the Terms and Conditions and agree to be legally bound by them. If you do not agree with these Terms and Conditions, please do not enter the competition.
The competition commences on the 1st of April 2021 at 9:00 a.m. and ends on 31st of July 2021 at 8:00 a.m.
These competition conditions apply to the “Recycle” of Nespresso Cyprus 23 Lefkosias str. 2540 Dali, Nicosia to promote Nespresso. The Competition Conditions are available from Nespresso Cyprus and can be viewed on https://www.nespresso.com.cy/legal1. HOW TO ENTER
1.1 How to enter the competition:
a) If you already have a Nespresso account, fill your recycling bag with capsules.
b) If you do not have a Nespresso account and want to enter the competition, create an account at Nespresso and choose your Nespresso Club Membership and proceed with at least one coffee purchase.
c) The competition voucher will be completed from you with your physical presence at a Nespresso Boutique, with the help of a coffee specialist. Otherwise, for distant orders, a sticker, that may be ordered online, must be inserted on the recycle bag. For each of the two mentioned methods, you will be required to write your name, surname, address, postal code, town/city and customer number. d) Affix the competition sticker to your recycling bag with approximately 200 aluminum capsules.
e) Return your full recycling bag to a Nespresso approved return point, such as the courier that delivered the Nespresso order, or to one of the Nespresso boutiques.
1.2 One sticker per recycling bag.
1.3 You can enter the competition as many times as you wish, but for each entry your recycling bag must be completely full (+/- 200 capsules).
1.4 Submit capsules between 1st of April 2021 and 31st of July 2021 and you may win the prize.

1.5 Please, ensure to enter your contact details correctly and that your contact details provided in your account are updated. In case you win the competition, this information will be used to contact you. In case of wrong contact details, Nespresso is not obliged to contact you and will proceed to a re-draw.
2. ELIGIBILITY FOR PARTICIPATION

2.1 Only registered customers with an eligible Nespresso account can participate in this competition.
2.2 This Competition is open to anyone residing in Cyprus with a fixed abode or permanent residence where he/she is registered.
2.3 This Competition is open to people aged 16 years and over. People aged under 18 years can only enter this Competition with the written consent of their parent/guardian.
2.4 This Competition is not open to:
a) Employees of Nespresso and Vassos Eliades Ltd and all other persons directly involved in the organization of the Competition
b) Persons entering as part of an organized partnership, either as part of legal or de facto association or as part of any other form of cooperation intended to increase their chances of winning, or persons suspected of fraud by the organizing companies
2.5 By entering the Competition, you confirm your eligibility for participation. If Nespresso suspects that an entrant was not eligible to enter the competition, it may require proof of eligibility and in case you are not eligible, Nespresso will immediately terminate your participation.
2.6 Incomplete entries will be ineligible to win the Prize.
2.7 By entering the Competition, the Participants (“Participants”) confirm that they agree with the present Terms and Conditions.
3. COMPETITION STRUCTURE
3.2 3.1 The Campaign period (“Campaign Period”) shall run from the 1st of April 2021 to 31st of July 2021. Entries received after this date will no longer come into consideration for a prize and will not be accepted.
3.3 Stickers and recycling bags are available in the Nespresso boutiques and via www.nespresso.com.cy or by calling the Nespresso Club on 8000 22 33. These stickers apply to this campaign only and will be available until 31st July 2021.
3.4 The competition has only ONE winner, who will win a Velosophy bicycle made of recycled aluminium that amounts to €1290 (1x) “hereinafter the “prize””.
3.5 One draw will be held during the Campaign Period, i.e. 15th of August 2021. The time and date of draw will be announced on the Competition’s website. The winner is randomly chosen via an electronic draw that will take place impartially and at the presence of an independent observer.
3.6 The decision of Nespresso is final and there is no discussion to it.
3.7 At a participant’s request, Nespresso shall show through press and social media posts, how the winner has been chosen through the draw and the procedure of the draw.
3.8 The Winner shall be notified by phone no later than two weeks after the draw date.
3.9 If the Winner cannot be contacted within a period of 72 hours from the Prize draw time, and attempts were made to contact the winner then a re-draw will occur under the same conditions.
3.10 The winner must claim their Prize within 14 days of the Draw Date by contacting Nespresso directly and personally and by verifying his/her details through an email, text or by going to one of the Nespresso Boutiques. If the winner does not do so, Nespresso will proceed to a re-draw and announce another eligible winner.
3.11 The Winner will be asked to give his/her name, address, postal code, town/city and customer number to enter the Competition.
3.12 The gift will be sent two weeks after the winner has claimed the prize. The gift will be delivered via courier to the address specified by the Participants/Winner.

3.13 In case of change of your contact details, such as telephone number and/or address, you must inform Nespresso.
3.14 Only the winner shall be notified of the result.
3.15 If the winner is aged under 18 years, then the prize will be awarded to the winner’s parent/guardian on their behalf.
4. PRIZE
1X RE: CYCLE Velosophy & Nespresso bike from recycled capsules (worth €1290)
4.1 The winner of the Competition will win one Velosophy bike made of recycled aluminium to the amount of €1290.
4.2 The winner is the Nespresso-account holder, and the Prize is personal and not transferable.
4.3 The Prize is not exchangeable and/or cannot be redeemed for cash.
4.4 To collect the prize, proof of identity will be required by the winner and if there is a refusal to provide proof of identification, Nespresso reserves the right not to hand over the prize to the winner.
4.5 The effective amounts of the prize established beforehand by Nespresso to this Competition shall depend on the actual amount required to release the winning prize. No compensation shall be granted to Participants if it becomes apparent that the eventual effective value of the Prize is lower than the amount initially specified by Nespresso.
5. PRIVACY
5.1 Participants are obliged to provide correct, up-to-date and complete information. Nespresso may ask participants to provide proof of their identity, any consent required by a third party (e.g. parents) and valid registration at the specified adobe or permanent residence. Participants who submit incorrect personal data shall not come into consideration for prizes and their entry to the competition will not be accepted.
5.2 The (personal) data required to enter this Competition shall be processed by Nespresso in accordance with Nespresso’s Privacy statement as published on https://www.nespresso.com.cy/en/service-faq/question/id/9
5.3 The personal data provided by the Participant to Nespresso in connection with the Competition are kept in a data file and all the appropriate measures are in place to protect that file. Nespresso respects your privacy. The General Data Protection Regulation applies to this data file. By entering the competition, participants give Nespresso their consent to use all their necessary personal data for the organization and execution of the Competition.
5.4 We will use your personal information we collect from you in order to administer this Competition, as per the provisions of the GDPR. We will use your information only for the purposes of this Competition and will destroy them one month after the competition. The information collected shall be deleted one month after the delivery of the prize
5.5 Winner’s images, name and city details may be used for promotional purposes following their written consent.
6. GENERAL

6.1 Nespresso reserves the right to terminate/cancel the Competition, discontinue the draw, extend the draw, or to change the rules, prizes, the present terms and conditions, provisions and information at its own discretion and without prior notice, without Nespresso accepting any liability for any damages towards the participants.
6.2 The competition terms and conditions shall not be changed to the detriment of the participants during the course of the Competition.
6.3 Nespresso is not liable and has not any responsibility for entries lost or delayed or for any associated costs to claimants.
6.4 Nespresso reserves the right to validate winning entries.
6.5 Nespresso reserves the right to exclude any entries that appear to be fraudulent or in a breach of the rules.
6.6 If you are not able to enter the competition due to technology issues or other issues that are not and cannot be handled by Nespresso, Nespresso will not be liable to you.
6.7 The latest version of the competition conditions, cancellation of the Competition or changes to the Competition’s rules shall be published by Nespresso on the competition website and shall be effective and binding on the participants from the time of its posting on the Website. Therefore, you are advised to check from time to time the Terms and Conditions of the Competition for your update. If you do not agree by any changes made to the Competition rules or Terms and Conditions, you should terminate your participation. If you do not cancel your participation, you agree to be bound by the latest version of the Terms and Conditions of the Competition.
6.8 All copyrights and other intellectual property rights relating to all text, images and other materials on the Competition’s website are owned by Nestle Nespresso SA. All material and content contained in this Website is made available for your personal and non-commercial use only. No part of the content of this Competition and/or publication may be reproduced or published without Nespresso’s explicit consent.
6.9 The laws of Cyprus are applicable to this promotion and this promotion is in accordance with the laws of Cyprus. Any disputes arising from the competition shall be in the exclusive jurisdiction of the competent court in Cyprus. In case of a dispute or any complaint you have against Nespresso, please first contact Nespresso, in order to resolve the dispute.
6.10 To the fullest extent permitted by the law, Nespresso and its affiliated companies shall not accept any liability for damage arising from access to, use of or the reliability of the information on the Competition website or any linked site, unless such damage is attributable to an intentional act or gross negligence on Nespresso’s part.
6.11 To the fullest extent permitted by the law, Nespresso accepts no liability for any consequential damage caused by the Competition, accidents, loss, injury, or any misuse of the prize. Moreover, Nespresso does not accept any liability in relation to any late deliveries, damage or additional costs arising from the Competition, the promotional campaign, the award of the prize or the receipt of the prize. Nespresso does not accept any liability for damage arising from errors in print. Reservation is made relating to any changes, printing and typesetting errors. Nespresso does not accept any liability for any technical error and/or delay in the submission of entries.
6.12 Nespresso is not responsible if the Competition cannot take place in the event of force majeure and no claim can be brought in this case.

The Customer service handles your questions and if necessary, it will inform the competent Nespresso Department. Depending on the nature of your question/comment and the method you used to contact the Customer Service team, you will receive a reply by telephone, post, or email. You will receive a reply within 4 weeks at the latest.

NESPRESSO & YOU MEMBERSHIP TERMS AND CONDITIONS


These terms and conditions (T&C’s) govern your membership to Nespresso & YOU operated by Nestlé
Nespresso SA. As a member of Nespresso & YOU, you accept and are bound by these T&C’s. Please
read these terms and conditions carefully. You are responsible for reading and understanding these
T&C’s.
This version of the Terms and Conditions came into effect in Cyprus on 04/02/2021 and will remain
valid until it is amended or replaced.


1. What is Nespresso & YOU Membership?
Nestlé Nespresso SA (40 avenue de Rhodanie 1003 Lausanne ("we" or "us") operates a customer
recognition programme.
Nespresso & YOU is a tiered benefits programme designed so that you enjoy even more special services,
such as updates on new products and services offered by our company, participation in contests, exclusive
benefits, rewards and updates on offers and discounts and more.
Membership is free of charge. There are three levels of membership and your level is determined by the
number of years of continuous membership and the amount of capsules purchased during 12 months
starting at your first purchase of Nespresso coffee. The Purchase must be made as an identified member
directly through a Nespresso channel.


2. How to become a Nespresso & YOU Member?
By registering with Nespresso at Nespresso.com.cy, Nespresso APP, CRC or at one of our Boutiques
and making your first coffee purchase, you will automatically become a member of Nespresso & YOU.
Upon registration you will receive your unique Membership ID, which will be indicated on the first
invoice you will receive. Please make sure that you keep safe your Membership ID.
Upon your registration, you will be required to provide us with your contact details, including First Name,
Last Name and Email address, in order to facilitate your membership. Your registration may be deemed incomplete and thereupon invalid, in case of failure to provide the required details. Please ensure that on
your registration you provide the correct and complete mandatory registration information.
Members must not provide false or misleading information on registration and must not alter, reproduce,
disclose or in any way interfere with the details of other Members.
Please inform Nespresso promptly, in case of change of address or any other changes of your personal
information. It is your responsibility to ensure that your contact details with Nespresso remain up to date.
If your registration is valid, your membership will commence upon the completion of the registration
when you receive your unique Member Number and upon the purchase of your first coffee.
If you are already registered as a Member, the date of commencement of your membership will be the
date of your first coffee purchase via the qualifying Nespresso channels.
By becoming a member, you agree that you have read and accept these T&C’s. Further, you consent to
the collection, use and disclosure of your personal data by Nespresso, in accordance with the Company’s
Privacy Policy. Our use of your personal details is governed by our Privacy Policy which you should
read carefully. By consenting to these Terms and Conditions and by providing your personal information
to us, you consent to the terms of the Privacy Policy. You are responsible for reading and understanding
the Company’s Privacy Policy.
Upon your registration, you will be asked to create a password. You must keep your membership number
and password safe and strictly confidential and not divulge them to any third person. You must not allow
others to use your registration details and password to access the Website. You agree to immediately
notify us of any unauthorised use or suspected unauthorized use of your registration details and password
or any other breach of security of which you become aware. You are fully responsible for the use of your
password and any orders placed under it, even without your knowledge.
Members must not assign their benefits and obligations under the T&C’s to a third person. Your membership commences upon your first coffee purchase. To maintain your Nespresso & YOU
membership, you must have made at least one valid coffee order within the last 12 months. Corporate
bodies, partnerships, trade associations and other commercial bodies are excluded. Joint or family
membership is not available.


3. Who can become a member?
 Customer must be a resident of Cyprus.
 Customer must be aged 18+.
 Employees of Nestlé, Nespresso or any associated entities, its agents or anyone else
professionally connected with the Nespresso & YOU programme may not be eligible to
membership benefits (including the exclusion of accessories and machine discounts offered
under the Nespresso & YOU membership).
 There is a limit of one Nespresso Membership Level per customer.
 An individual may join the Membership programme, but may have not Duplicate Accounts
under it. If more than one Nespresso & YOU membership account is assigned to an individual,
duplicate accounts may be cancelled.


4. Membership Levels
Nespresso & YOU has three membership levels:
 Connoisseur: To maintain the membership benefits, members must purchase up to 500
capsules within a 12-month period, and/or have 5 years or LESS continuous membership.
 Expert: To maintain membership benefits, members must purchase between 501 and 1,000
capsules within a 12-month period, and/or have between 5 to 9 years continuous membership.
If you do not make a valid purchase as per your membership within each 12-month period
following the activation of the membership, your account will be deemed inactive and reset to
a ‘Connoisseur’ level.
 Ambassador: To maintain membership benefits, members must purchase more than 1,000
capsules within a 12-month period and/or have more than 10 years of continuous membership*.
If you do not make a valid purchase as per your membership within 12 months, your
membership will be deemed inactive and reset to ‘Connoisseur’ level.Your membership level depends on your account longevity or the volume of coffee capsules
ordered. Your Membership Tier and Member details will be determined solely on the records
of Nespresso Cyprus / Vassos Eliades Ltd and data in accordance with this Nespresso & YOU
T&C’s and other related Nespresso Cyprus terms. (e.g., Conditions of Sales etc)
‘Level calculation’ is made by cross-referencing the number of years you have continuously
been a member of Nespresso & YOU and the number of capsules purchased. Your account
longevity is based on the complete years during which you have purchased at least one coffee,
starting on your first purchase. For information concerning your account longevity you can visit
our website and click on “My Account” section or by speaking to a Coffee Specialist in a
Nespresso Boutique or via Nespresso Call Center.
‘Capsules consumption’ means the number of capsules purchased and is calculated between
two Anniversaries. Your first Anniversary refers to your first coffee purchase through one of
the qualifying Nespresso Channels as an identified Member. For information concerning your
capsules consumption you can visit our website and click on “My Account” section or by
speaking to a Coffee Specialist in a Nespresso Boutique or via Nespresso Call Center.
Members should allow at least one full working day from order completion for membership
details to be administered and updated on their account.
By ‘Anniversary’ we mean the month (not the day) of your first coffee purchase from
a valid Nespresso channel.
‘Number of years’ means the number of a full 12 month period with at least one coffee
(Original) purchase since your first coffee purchase.
Details of the number of years of your membership and capsule consumption can be found
within “My Member Status” on your membership page at https://
www.nespresso.com.cy/benefits
“Date of purchase” means the shipping date of the coffee capsules.
“A valid capsule purchase” means:• The number of purchased capsules (invoiced capsules within a valid order):
• Including Original capsules
• Cancelled/Returned orders are excluded and will be deducted from qualifying total
consumption numbers
• Free of charge capsules are not included
• Only capsules purchased directly from Vassos Eliades Ltd can be counted as part of a
member’s capsule consumption. Purchases made from retailers or other channels cannot be
added and will not be included in a member’s total consumption numbers.
Members should allow at least one full working day (24 hours) from order completion for level
changes and/or capsule purchase quantities to be administered and reflected/visible on their
account statement; Member benefits are available via Nespresso direct channels only and cannot
be redeemed via any other retailer.
Your Nespresso & YOU Membership level can be viewed by logging in the Nespresso website
or by contacting a Coffee Specialist in a Boutique or via our Customer Relationship Centre.
All related benefits, rebates and discounts will be shown on your account and will only be visible
while logged in.
Your Nespresso & YOU level will be determined solely based on our own records and data and
in accordance with the Nespresso & YOU terms and conditions.
Vassos Eliades Ltd. will not amend a member’s level status retrospectively based on any other
data source.


5. Membership Benefits
Nespresso Membership Benefits are offered to you free of charge and we reserve the right to
discontinue or change all or part of the Benefits, terms and conditions or the content of the website, at
our sole discretion at any time with or without notice. All Benefits are subject to availability and may only be acquired by the members upon presentation of
their valid Membership Card. Proof of identification may be required to acquire the benefits.
If you lose or no longer possess your Membership Card contact Nespresso on 8000 22 33 for its
replacement.
Below you will find all Membership Benefits and to which Membership Level they apply to.

1. RECYCLE AT HOME (applies to ‘Connoisseur’, ‘Expert’ and ‘Ambassador’ Memberships).
Enjoy recycling at home free of charge, by requesting the collection of your used capsules upon
delivery.
2. FREE DELIVERY WHEN YOU PURCHASE 100 OR MORE NESPRESSO CAPSULES
(applies to ‘Connoisseur’, ‘Expert’ and ‘Ambassador’ Memberships)
100 capsules must be purchased in a single transaction with up to 48 hours delivery. For sameday delivery please check time-slots availability.
The offer of complimentary delivery cannot be exchanged for cash or product of equivalent
value. Not valid in conjunction with any other offer and cannot be claimed via the Nespresso
Boutiques.
3. MASTERCLASS (applies only to the ‘Ambassador’ Level Membership)
Participate in our regular and interactive Masterclasses where you can discover the world of
Nespresso coffee with the help of our Coffee Specialists.
To participate you need to register online at https://www.nespresso.com.cy/en/contactus
Masterclasses are held within selected locations and can accommodate a maximum of 10 people
per session and are subject to availability and government restrictions on gatherings.
4. MACHINE DISCOUNT (‘Expert’ and ‘Ambassador’ Level Memberships)
‘Expert’ and ‘Ambassadors’ Level Memberships benefit from a 40% discount on machines of
their choice with the purchase of a pre-determined number of capsules.To be entitled to the above discount, the number of minimum capsules that must be purchased
per machine model are the following:
Essenza Mini:120 cps
Essenza Plus: 150
Pixie: 150 cps
Citiz: 150 cps
Citiz&Milk: 300 cps
Lattissima One: 300 cps
Lattissima Touch: 500 cps
Lattissima Pro: 1200 cps
The offer applies when the new machine is purchased from a direct Nespresso channel in
Cyprus. The discount cannot be applied to machines purchased via any other retailer.
Nespresso reserves the right to apply certain restrictions when additional promotions are being
run. Such restrictions will be announced within the terms of each individual additional
promotion and will be at the sole discretion of Nespresso.
Clarifications:
 The offer must be claimed instantly as a whole.
 Barista device is excluded from this offer.
 Each member entitled to the discount may use it to purchase up to three machines of their choice
during the validity period of this offer.
 This offer cannot be combined with any other machine promo activities. In case there is already
a discount or any other offer available to Nespresso customers, Members cannot use the above
offer to purchase a machine.
 Nespresso reserves the right to apply additional restrictions at its sole discretion.
5. FREE DESCALING KIT (‘Expert’ and ‘Ambassador’ Level Memberships)
Receive a Free Descaling Kit once you have purchased 500 capsules within the year.
The free descaling kit will be automatically added to your order once you have purchased 500
capsules, but it is limited to one kit per year, per member.6. ACCESSORIES DISCOUNT (‘Expert’ and ‘Ambassador’ Level Memberships)
‘Expert’ Level Membership includes a 20% discount on the purchase of any item from our
Accessories from the ranges of Cups and Food & Bites.
Such purchases are not for resale. In some instances, the offer of 20% discount may be limited
to a maximum number of items per member.
‘Ambassador’ Level Membership includes a 25% discount on the purchase of any item from
our Accessories, from the ranges of Cups and Food & Bites.
Such purchases are not for resale. In some instances, the offer of 25% discount may be limited
to a maximum number of items per year.
Clarifications:
 The accessories and food and bites must be purchased from Nespresso and particularly, only
through the Nespresso Boutiques, the call center, the Nespresso Online Shop and the Nespresso
mobile application.
 The claim must be claimed instantly as a whole.
 Aeroccino descaling kit, Limited Edition accessories and food and bites are excluded from this
offer.
 This offer cannot be combined with other accessories and food and bites promo activities in
case there is already an offer available for these products.
7. DRAW EXPERIENCE GIFT (applies only to the ‘Ambassador’ Level Membership)
‘Ambassador’ Level Members enjoy the ability to enter our Draw Experience Gift for the
possibility to win various experiences.
8. ANNIVERSARY MONTH GIFT (applies only to the ‘Ambassador’ Level Membership)
Make a purchase in your anniversary month and receive an anniversary gift.
9. MACHINE WARRANTY & SERVICE (applies to ‘Connoisseur’, ‘Expert’ and
‘Ambassador’ Memberships)Nespresso provides a full, comprehensive service to our customers who are experiencing
technical difficulties with their machine.
‘Connoisseur’ Level Membership: 2 years warranty including free Pick Up and Repair Service
of your machine and use of a free loan machine whilst we repair it.
‘Expert’ Level Membership: 2+1 years warranty including free Pick up and Repair Service and
use of a free loan machine whilst we repair it.
‘Ambassador’ Membership: 2+2 years warranty including free Pick Up and Repair Service of
your machine and use of a free loan machine whilst we repair it.
Loan machines are subject to availability and may differ from your existing machine. Loan
machines remain the property of Vassos Eliades Ltd. The machine is returned to the pick-upaddress and all repairs are covered with a six-month limited repair warranty. This limited
warranty is subject to specific terms and conditions.
The warranty period commences on the date of purchase and Nespresso requires
presentation of the original proof of purchase to ascertain the commencement date.
This limited warranty is subject to specific terms and conditions. Please consult full T&C’s for
more information.
The terms of this limited warranty do not exclude, restrict, or modify, and are in addition to the
mandatory statutory rights applicable to the sale of the Product to you.
The terms of this warranty do not apply to the exercise of your statutory rights. Other than the
statutory rights to which you are entitled to by law, all warranties, conditions and other terms
not set out in the existing terms of warranty are excluded from this warranty.
If any provision or part-provision of this warranty is or becomes invalid, illegal or
unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid,
legal and enforceable. If such modification is not possible, the relevant provision or partprovision shall be deemed deleted. Any modification to or deletion of a provision or partprovision under this clause shall not affect the validity and enforceability of the rest of this
warranty.
Should the cost of repairs or replacement not be covered by the terms of this limited warranty,
Nespresso will advise the owner and the cost shall be charged to the owner.
LIMITED WARRANTYNespresso warrants your coffee machine against defects in materials and workmanship for a period of 2
years. The warranty period begins on the date of machine purchase and Nespresso requires presentation
of the original proof of purchase to ascertain the start date.
During the warranty period, Nespresso will either repair or replace, at its discretion, any defective
Product. Replacement products or repaired parts will be warranted only for the unexpired portion of the
original warranty or six months, whichever is greater.
If the Product includes a number of accessories, only the defective part or accessory will be replaced.
Nespresso reserves the right to make minor adjustments instead of replacing the Product or accessory.
Should the cost of repairs or replacement not be covered by this warranty, Nespresso will advise the
owner and the cost shall be charged to the owner.
This warranty is only valid for active Nespresso customers registered in Cyprus. To be an active member
you must be registered and you must have ordered coffee in Cyprus within the last 12 months.
This limited warranty shall be the full extent of Nespresso’s liability however caused; and Nespresso
excludes liability for any loss or damage which is not foreseeable. Loss or damage is foreseeable if it is
an obvious consequence of our breach of applicable contractual terms or negligence, or where it could
be contemplated by you and us at the time you purchased the Product.
Nespresso has no liability to you for any loss of profit, loss of business, business interruption or loss of
business opportunity.
This warranty does not apply to any defect resulting from negligence, accident, misuse, or any other
reason beyond Nespresso’s reasonable control, including but not limited to: normal wear and tear,
negligence or failure to follow the product instructions (including insufficient aftercare or cleaning),
improper or inadequate maintenance, calcium deposits or descaling, connection to improper power
supply, unauthorized product modification or repair, use for commercial purposes, fire, lightning, flood
or other external causes.
This warranty will not apply if any serial number has been removed or defaced or if Nespresso receives
information from any public or governmental authority that the Product has been stolen.
This warranty does not cover the cost of claiming under the warranty or transporting the goods to and
from the place of purchase. This warranty is a limited voluntary warranty. The terms of this warranty do
not exclude, restrict or modify, and are in addition to, the mandatory statutory rights applicable to the
sale of the Product to you. The terms of this warranty do not apply to the exercise of your statutory rights.
Other than the statutory rights to which you are entitled at law, all warranties, conditions and other terms
not set out in this warranty document are excluded from this warranty.If any provision or part-provision of this warranty is or becomes invalid, illegal, or unenforceable, it shall
be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such
modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any
modification to or deletion of a provision or part-provision under this clause shall not affect the validity
and enforceability of the rest of this warranty.
Loan machines shall be returned to Nespresso in as good as a condition when received by Nespresso.
During the loan period of any loan machine, you are fully responsible of keeping safe such machines and
you agree to assume all responsibility for maintenance and repair of loan machines that are damaged,
lost, confiscated, or stolen from you during the loan period.
If the loan machine is lost, stolen, or damaged, you agree to notify Nespresso immediately.
Upon the end date of the loan period, you shall return the loan machine to Nespresso.
How to Claim Under the Nespresso Warranty
If you believe your Product is defective, contact the Nespresso Customer Care directly for instructions
on how to proceed with a repair.

6. Termination of Membership
If you wish to terminate your membership, you may do so at any time by writing to Vassos Eliades Ltd
via postal mail (23 Lefkosias Str. 2540 Dali Industrial Area, Nicosia, Cyprus) or via email at
info@nespresso.com.cy or by calling the free number 8000 22 33. In this case, we will undertake to
remove and securely delete your personal details.
Nespresso reserves the right to investigate any unusual activity on any account, which it believes or
have reason to believe, may be in breach of these T&C’s. Any such activity may result in the suspension
and possible termination of an account.
Nespresso may terminate your membership with immediate effect by giving you written notice, if you:
 breach any of these terms and conditions; abuse the Benefits;
 Act in a manner inconsistent with applicable laws or regulations;
 Act in an inappropriate, fraudulent, abusive or hostile manner.
Nespresso may terminate this programme at any time upon three months’ notice to you. Nespresso may
terminate this programme or any membership immediately in any jurisdiction if required to by applicable
local law.
If any provision of these T&C’s is or becomes for any reason whatsoever invalid, illegal or
unenforceable, it shall be divisible from these T&C’s and shall be deemed to be deleted from them and
the validity of the remaining provisions shall not be affected in any way.
Nespresso is not responsible for any claims or damages arising from use of any benefits or services
provided by a third party.
Once your membership at Nespresso & YOU is terminated, all your membership rights and benefits
cease to exist immediately and may not be reinstated or transferred.

7. Indemnity
Nespresso’s decisions on all matters relating to the Nespresso & YOU membership including the
Membership Benefits are final, binding and conclusive on all members and no correspondence will be
entertained in this regard.
Nespresso disclaims, to the fullest extent permissible by law, all liability for losses, damages and costs
whatsoever, (whether direct, indirect, consequential or otherwise), arising, either directly or indirectly,
from your membership, the benefits or the use of any material contained on the website by you, including without limitation any acts or omissions, whether those losses, claims, or damages result from our
negligence or otherwise.
We do not exclude our liability to you for:
(a) death or personal injury caused by our negligence; or
(b) fraudulent misrepresentation by us.
In respect to our Products and Services, Nespresso’s liability is limited to what is explicitly stated in
these T&C’s. To the extend permitted by the law, all other liabilities are excluded.
Nespresso is not responsible for any requests or damages derived from the use of the advantages or
services provided by third parties.

8. Waiver
You are fully bound by these T&C’s and shall not breach any term or condition. The Company’s failure
to insist upon strict compliance with these T&C’s by any member will not be deemed as a waiver of any
rights or remedies the Company obtains against that or any other member.
Nespresso may waive compliance with these T&C’s in its sole discretion and may run promotions from
time to time that provide enhanced benefits for members.

9. Entire Agreement
These Terms and Conditions together with the Privacy Policy constitute the entire agreement between
you and us regarding your membership and the Benefits under the Nespresso & YOU membership, which
means that you will not be able to claim that we made any representations or warranties other than
contained in these T&C’s.
Please note that additional T&C’s of sales apply to the purchase of our products or services.
Nespresso and its Members acknowledge that the headings to the sections are for reference only and shall
not be used in the interpretation of the Terms and Conditions.

10. Protection of Personal Data
At Nespresso we take the protection of your personal data very seriously. That is why we take all the
necessary technical and organizational measures to keep them safe. All personal data and other
information of personal nature submitted to our Website are governed by our Privacy Policy. You can

11. Law and Jurisdiction
The present T&C’s are governed by and construed in accordance with the laws of Cyprus, and we both
agree that the courts of Cyprus will have exclusive jurisdiction and in particular, the Nicosia District
Court in case of any dispute or claim arising out or in connection with these T&C’s.
As per the law, certain communications shall only be performed in writing. You hereby agree that
Nespresso may contact you by email or mail, and that such communication falls under the legal definition
of written communication.

Points of Sales. Demonstrators present in physical third party stores to assist you with the registering of your machine and coffee ordering. 

Data from other sources. Third party social networks (e.g. such as Facebook, Google) or market researches (if feedback not provided on an anonymous basis). 


2. PERSONAL DATA THAT WE COLLECT ABOUT YOU AND HOW WE COLLECT IT 
Depending on how you interact with Nespresso (online, offline, over the phone, etc.), We collect various types of information from you, as described below. 

Personal contact information. This includes any information you provide to Us that would allow Us to contact you, such as your name, postal address, e-mail address, social network details, or phone number 

Account login information. Any information that is required to give you access to your specific account profile. Examples include your login ID/email address, screen name, password in unrecoverable form, and/or security question and answer. 

Demographic information & interests. Any information that describes your demographic or behavioural characteristics. Examples include your date of birth, age or age range, gender, geographic location (e.g. postcode/zip code), favorite products, hobbies and interests, and household or lifestyle information. 

Technical information about computer/mobile device. Any information about the computer system or other technological device that you use to access one of our Websites or apps, such as the Internet protocol (IP) address used to connect your computer or device to the Internet, operating system type, and web browser type and version. In addition to Nespresso entities and Vassos Eliades Ltd entities or ad-hoc in-country partners (in charge of Nespresso operations) mentioned in the data controllers & contact section (see Section 11), We share your Personal Data with the following types of third party organisation:

These are external companies that We use to help Us run our business (e.g. order fulfilment, payment processing, fraud detection and identity verification, website operation, market research companies, support services, promotions, website development, data analysis, CRC, etc.). Service providers, and their selected staff, are only allowed to access and use your Personal Data on Our behalf for the specific tasks that they’ve been requested to carry out, based on our instructions, and are required to keep your Personal Data confidential and secure. When signing up for an online account, please be sure to choose an account password that would be difficult for others to guess and never reveal your password to anyone else. Nespresso Conditions of Sales

1. Definitions

Where the following terms appear in these present terms and conditions:

“Products” means the products sold by Nespresso.

“Nespresso” means the company bearing the name «Vassos Eliades Ltd», a distributor of NESTLE Nespresso S.A., having its registered office in Nicosia, Dali Industrial Area at the address 23, Lefkosias Str., 2540.«Services» means the Services provided by Nespresso to its clients.

2. Essential conditions

The present general terms: (a) govern all orders and purchases made to Nepsresso, in any means whatsoever. In particular for purchases made on the internet, kindly refer to our site for further specific provisions, (b) apply to your participation as member of the Club Nespresso and the provision of Products and Services, (γ) may be modified by Nespresso at any time by sending a notice to you or by posting an announcement in the pages that apply to Cyprus on the website www.nespresso.com.cy.

3. Orders

3.1. You may place your orders for Products and Services in the following manners:

3.2. The minimum coffee packaging contains 10 capsules.

3.3. With regard to orders not placed at retail stores, each order must refer to minimum quantity of 50 capsules.

3.4. All orders are subject to the limitations of stock availability. Nespresso shall inform customers as soon as possible for any rupture of stock.

3.5. Nespresso reserves the right to refuse orders, in total or in part, or to request and advance payment of the order value, in case low creditworthiness of the candidate buyer is detected.

4. Delivery and acceptance (of delivery)

4.1. Nespresso shall make every effort to provide the Products and Services at the address stated in your order, within 3-5 working days and 3-5 working days for addresses that are located in inaccessible areas. please allow up to 3-5 working days before contacting us. If, due to a particular reason or force majeure, the aforementioned desired delivery times cannot be met, you will be informed in a timely manner.

4.2. If you wish the delivery of Products or Services to be made in a different way than the one provided for by Nespresso, you must communicate such request to Nespresso and if accepted, you shall incur all relative expenses.

4.3. Ownership of the Products and any risk involved is transferred to you at the time you receive them.

5. Returns

5.1. You have the right to return any merchandise that does not suit you within 30 days following the acceptance of delivery.

5.2. Nespresso accepts only returns of merchandise brand new and in their original condition and packaging, accompanied by the relative invoices. In such conditions, Nespresso will reimburse the amount paid for the returned products within 30 days after the reception of said products. Any postage expenses involved for the return of the money shall be at your charge.

5.3. You are responsible for verifying the quantity and quality of the merchandise upon delivery and in case of defective merchandise, you must inform Nespresso accordingly within 30 days after the reception of the merchandise. If the product that you have purchased is indeed defective, Nespresso may repair or replace it or reimburse you, in accordance with your legal rights. If you do not inform Nespresso within the aforementioned 30-day deadline, the order is regarded as accepted.

5.4. More in particular, Nespresso machines are covered by a legal 2-year warranty by their constructors, in accordance to the special terms and conditions stated in the documents accompanying the machines. For any issue that may arise in respect of the functioning, maintenance and after-sales service of your Nespresso machine, we kindly ask you to contact Nespresso at the following numbers: 8002233 (free phone).

5.5. When returns are properly completed, Nespresso shall replace the merchandise returned, if they are proven defective, or reimburse the price paid, within a maximum of 30 days upon the reception of the returned merchandise.

6. Product prices and modes of payment

6.1. Nespresso may change the prices of the Products and Services by notifying consumers in the most convenient means.

6.2. You will pay the price of the Product and Services that is applicable at the time that the order is placed.

6.3. Prices are inclusive of VAT but not transportation expenses.

6.4. The minimum order is set to 50 capsules for packing purposes, excluded 24 hour delivery which costs € 9.00.

6.5. The invoiced value shall be paid in cash upon delivery of the Products or provision of Services, regardless of the means in which the order was placed (unless credit has been agreed).

6.6. Payment by means of post dated bank cheques is not accepted. Minimum order quantity is set to 50 capsules, for packaging reasons. Delivery within 24 hours is excluded and has additional freight charges of €9.00.

6.7. If the address for the delivery of the products is different than the one mentioned on the invoices, then the invoiced priced must be paid prior to delivery.

7. Participation at the Club Nespresso

7.1. When Nespresso receives your coffee order, you automatically become a member of the Nespresso Club.

7.2. Your Nespresso Club Member number is stated in the first invoice that you will receive. In order to serve you better, please keep this number at hand for all your future orders.

7.3. Your participation to the Nespresso Club gives you the right to benefit from special Services proposed, such as receiving information on new products and services offered by our company, participating to competitions, being informed on offers and other advantageous services.

7.4. Your membership to the Nespresso Club cannot be transferred to a third party.

7.5. It is your responsibility to ensure that the contact details your provide to the Nespresso Club remain up to date.

8. Liability

8.1. With regard to Products and Services, Nespresso's only liability is limited as expressly stated in the present Conditions of Sales. To the extent permissible by law, all other liability is excluded.

8.2. Nespresso has no responsibility (whether contractual or non contractual or other) for any direct, special, consequential or indirect damage or tort, including loss of income, that may result from the sales described herein.

9. Personal Data Protection

Nespresso does not disclose or transfer any of your personal data to third parties and strictly abides by relative Regulation and laws on personal data protection. Our company’s policy on personal data protection has been posted on our website www.nespresso.com.cy.

10. Applicable law

These terms and conditions are governed by and must be construed in accordance with the laws of Cyprus. The Courts of Cyprus have exclusive jurisdiction forsolving any disputes that may arise between you and Nespresso.
