Privacy Policy of Mobile App

1. 1.    Aim

This Mobile App Policy is supplementary to the Vassos Eliades Ltd Privacy Policy and along with the Terms and Conditions, aims to:

1. i.                   make you feel safe and secure when using the Mobile App (“the App”) with regards to the processes of the personal data executed through this App.
2. ii.                explain how Vassos Eliades Ltd (hereinafter the “Company”), operating under the brand “Nespresso” having its registered office at 23 Lefkosias, Dali Industrial Area, 2540, Nicosia, Cyprus https://www.nespresso.com.cy/, contact number 80002233), hereinafter referred to as " Nespresso", may use information Nespresso collects about you through the App, as well as your rights over any personal information about you Nespresso holds and processes as a Controller .
3. iii.             Nespresso addresses issues related to personal data and privacy with respect and as of primary concern. In this context, we are hereby addressing you Notice in accordance with Article 13 of Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as "GDPR") to inform you about how we collect and process your personal data for the use of Mobile App.

1. 2.    Purpose of Processing

Nespresso, collects the necessary personal data (‘’data’’) directly from you and not from third parties,  in order to enable you to use the App to collect bonus points which you will later redeem for gift vouchers. These data are kept with Nespresso as the purpose of the Mobile is to enable customers to collect bonus from purchases made as well as inform its customers for any upcoming contests, promotions and marketing purposes. Additionally, the data collected may be used to help us improve your shopping experience when using the Mobile App, to personalize your experience, to help you locate the nearest Nespresso Boutique and benefit from any promotions running, to process transactions including payment confirmation and deliver the purchased products or services requested as well as to provide customer support service.

Personal Data is data that can be used to directly or indirectly identify you. Personal data does not include information that has been irreversibly anonymized or aggregated so that it can no longer enable us, whether in combination with other information or otherwise, to identify you. Nespresso may retain the following necessary personal data, for the provision of services offered to you via the Mobile App:

1. 4.    Disclosure of Personal Data

It might be necessary to share your personal data with our associates so that we could provide for you the required service such us service providers and credit reporting agencies/debt collectors.

In no case, however, are we going to share your personal data for processing for purposes contrary to those described in this Policy without your prior notification.

1. 5.    Security

Nespresso shall process your personal data in a manner that ensures its protection by taking all appropriate organizational and technical measures for data security and its protection against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access and any other form of illicit processing. In addition, Nespresso has taken all appropriate measures to safeguard that any partner/associate is also practicing up to date policies for the protection of personal data as per our obligations as Data Controllers, to the extent that Nespresso controls your data.

1. 6.    Third Party Processes

While Downloading the App you need to know that Each App Store provider (Apple App Store or Google Play) automatically processes the following data when you download our app:

6.1  the App Store username

6.2  the e-mail address entered in the App Store;

6.3  your App Store account number;

6.4  the loading time;

6.5  payment information, and

6.6  the individual device ID number.

Nespresso has no influence on this data collection and are not responsible for it. More information about the data processing in question can be found in the respective App Stores’ data protection policies:

1. 7.    Use of the App

Your personal data will be stored by Nespresso and due to technical reasons by the service provider of the App within Cyprus at our databases which are located at premises owned by us for the duration of your membership with Nespresso and/or for a maximum period of two years from your last purchase.

Nespresso will also use your data to provide you with information about Nespresso  products, services, offers and news, provided you have already consented to that and on the legal basis of your consent (art. 6 par. 1 (a) of the GDPR).

Please note that where you have given your consent to the processing of personal information you may withdraw your consent at any time by sending an email to our Data Protection Officer (DPO). This shall not affect the lawfulness of any processing previously made on basis of your consent.

When using our app, the following information are automatically forwarded to the servers without our own action because these are technical functions Nespresso cannot alter:

7.1  the mobile terminal device from which you used our app;

7.2  the IP address of your mobile terminal device;

7.3  login date and time;

7.4  client request;

7.5  the http response code;

7.6  the volume of data transmitted, and

7.7  the version of the app you are using.

These are temporarily stored for a period of 180 days in a log for the purpose of protecting our systems, error analysis, abuse or fraud prevention as per Article 6(1)(f) of the GDPR, -  for the purposes of the legitimate interest of Nespresso, i.e. for troubleshooting purposes, for addressing your complaints or for possible legal disputes. At the expiry of that period the information is deleted automatically.

1. 8.    Your rights

This section presents your rights with respect to your personal data. These rights are subject to certain exceptions, reservations or limitations. Please submit your requests responsibly. We will respond as soon as possible and in any case within one (1) month of receipt of the request. If the review of your request is going to take longer, you will receive relevant information.

 

Nespresso ensures the exercise of your rights, as provided under the GDPR, as applicable:  the  right to information, the right to access, the right to rectification, the right to erasure («to be forgotten»), the right to restriction of processing, the right to data portability, the right to object, the right to withdraw consent.

Nespresso Conditions of Sales

1. Definitions

Where the following terms appear in these present terms and conditions:

“Products” means the products sold by Nespresso.

“Nespresso” means the company bearing the name «Vassos Eliades Ltd», a distributor of NESTLE Nespresso S.A., having its registered office in Nicosia, Dali Industrial Area at the address 23, Lefkosias Str., 2540.«Services» means the Services provided by Nespresso to its clients.

2. Essential conditions

The present general terms: (a) govern all orders and purchases made to Nepsresso, in any means whatsoever. In particular for purchases made on the internet, kindly refer to our site for further specific provisions, (b) apply to your participation as member of the Club Nespresso and the provision of Products and Services, (γ) may be modified by Nespresso at any time by sending a notice to you or by posting an announcement in the pages that apply to Cyprus on the website www.nespresso.com.cy.

3. Orders

3.1. You may place your orders for Products and Services in the following manners:

b)      through the Internet and more in particular on the website www.nespresso.com.cy

c)    by visiting a Nespresso boutique, i.e.: *Boutiques are curently closed please use other means to place your order *

3.2. The minimum coffee packaging contains 10 capsules.

3.3. With regard to orders not placed at retail stores, each order must refer to a minimum quantity of 50 capsules.

3.4. All orders are subject to the limitations of stock availability. Nespresso shall inform customers as soon as possible of any rupture of stock.

3.5. Nespresso reserves the right to refuse orders, in total or in part, or to request an advance payment of the order value, in case low creditworthiness of the candidate buyer is detected.

4. Delivery and acceptance (of delivery)

4.2. If you wish the delivery of Products or Services to be made in a different way than the one provided for by Nespresso, you must communicate such request to Nespresso and if accepted, you shall incur all relative expenses.

4.3. Ownership of the Products and any risk involved is transferred to you at the time you receive them.

5. Returns

5.1. You have the right to return any merchandise that does not suit you within 30 days following the acceptance of delivery.

5.2. Nespresso accepts only returns of merchandise brand new and in their original condition and packaging, accompanied by the relative invoices. In such conditions, Nespresso will reimburse the amount paid for the returned products within 30 days after the reception of said products. Any postage expenses involved for the return of the money shall be at your charge.

5.3. You are responsible for verifying the quantity and quality of the merchandise upon delivery and in case of defective merchandise, you must inform Nespresso accordingly within 30 days after the reception of the merchandise. If the product that you have purchased is indeed defective, Nespresso may repair or replace it or reimburse you, in accordance with your legal rights. If you do not inform Nespresso within the aforementioned 30-day deadline, the order is regarded as accepted.

5.4. More in particular, Nespresso machines are covered by a legal 2-year warranty by their constructors, in accordance to the special terms and conditions stated in the documents accompanying the machines. For any issue that may arise in respect of the functioning, maintenance and after-sales service of your Nespresso machine, we kindly ask you to contact Nespresso at the following numbers: 8002233 (free phone).

5.5. When returns are properly completed, Nespresso shall replace the merchandise returned, if they are proven defective, or reimburse the price paid, within a maximum of 30 days upon the reception of the returned merchandise.

6. Product prices and modes of payment

6.1. Nespresso may change the prices of the Products and Services by notifying consumers in the most convenient means.

6.2. You will pay the price of the Product and Services that is applicable at the time that the order is placed.

6.3. Prices are inclusive of VAT but not transportation expenses.

6.4. The minimum order is set to 50 capsules for packing purposes, excluded 24 hour delivery which costs € 9.00.

6.5. The invoiced value shall be paid in cash upon delivery of the Products or provision of Services, regardless of the means in which the order was placed (unless credit has been agreed).

6.6. Payment by means of post dated bank cheques is not accepted. Minimum order quantity is set to 50 capsules, for packaging reasons. Delivery within 24 hours is excluded and has additional freight charges of €9.00.

6.7. If the address for the delivery of the products is different than the one mentioned on the invoices, then the invoiced priced must be paid prior to delivery.

7. Participation at the Club Nespresso

7.1. When Nespresso receives your coffee order, you automatically become a member of the Nespresso Club.

7.2. Your Nespresso Club Member number is stated in the first invoice that you will receive. In order to serve you better, please keep this number at hand for all your future orders.

7.3. Your participation to the Nespresso Club gives you the right to benefit from special Services proposed, such as receiving information on new products and services offered by our company, participating to competitions, being informed on offers and other advantageous services.

7.4. Your membership to the Nespresso Club cannot be transferred to a third party.

7.5. It is your responsibility to ensure that the contact details your provide to the Nespresso Club remain up to date.

8. Liability

8.1. With regard to Products and Services, Nespresso's only liability is limited as expressly stated in the present Conditions of Sales. To the extent permissible by law, all other liability is excluded.

8.2. Nespresso has no responsibility (whether contractual or non contractual or other) for any direct, special, consequential or indirect damage or tort, including loss of income, that may result from the sales described herein.

9. Personal Data Protection

Nespresso does not disclose or transfer any of your personal data to third parties and strictly abides by relative Regulation and laws on personal data protection. Our company’s policy on personal data protection has been posted on our website www.nespresso.com.cy.

10. Applicable law

These terms and conditions are governed by and must be construed in accordance with the laws of Cyprus. The Courts of Cyprus have exclusive jurisdiction forsolving any disputes that may arise between you and Nespresso.

COFFEE PROMOTION TERMS AND CONDITIONS

1. Offers

Nespresso members, as part of a targeted action depending on their purchasing profile, will be entitled to a €5 discount on the purchase of coffee by purchasing a certain number of Nespresso coffee packages, either original line or vertuo line.

2. Validity

The capsules must have been purchased through Vassos Eliades Ltd sales channels, i.e. Nespresso Boutiques, and Nespresso Call Center from 06/03/2024 to 31/3/2023. The coffee discount can be redeemed from 01/04/2024 until 31/05/2024 from all the above Nespresso sales channels.

3. Clarifications

-The offer is only valid for Nespresso Members.

-Each beneficiary can take advantage of the offer only once.

- The redemption of the discount requires an order with a total value of coffee over €10, either for original line or for vertuo line, depending on the type of discount the member is entitled to.

-The offer is personalized and corresponds to a specific Nespresso membership number.

- The discount cannot be redeemed in parts.

-For online orders (www.nespresso.com & Nespresso mobile apps) and orders through the call center, there is a minimum order limit of 5. coffee packages.

- In the case of a return of the member's order and for the member to be entitled to redeem his discount, a new coffee order of equal or greater value must be placed in relation to the returned one.

- In case of returning the member's order and refunding it, the member is not entitled to redeem the discount.

- Corporate customers belonging to the HOTELS category, for whom a special commercial policy applies, are excluded from the offer.

-Employees of Vassos Eliades Ltd are excluded from the offer.

-This promotion may be combined with promotions that take place during the same time period and promotions that take place on the trade channel (N Back).

COFFEE PROMOTION TERMS AND CONDITIONS

1. Offers

Nespresso members, as part of a targeted action depending on their purchasing profile, will be entitled to a €10 discount on the purchase of coffee by purchasing a certain number of Nespresso coffee packages, either original line or vertuo line.

2. Validity

The capsules must have been purchased through Vassos Eliades Ltd sales channels, i.e. Nespresso Boutiques, and Nespresso Call Center from 06/03/2024 to 31/3/2023. The coffee discount can be redeemed from 01/04/2024 until 31/05/2024 from all the above Nespresso sales channels.
