0 Legal Mobile Application
- 1. Aim
- i. make you feel safe and secure when using the Mobile App (“the App”) with regards to the processes of the personal data executed through this App.
- ii. explain how Vassos Eliades Ltd (hereinafter the “Company”), operating under the brand “Nespresso” having its registered office at 23 Lefkosias, Dali Industrial Area, 2540, Nicosia, Cyprus https://www.nespresso.com.cy/, contact number 80002233), hereinafter referred to as " Nespresso", may use information Nespresso collects about you through the App, as well as your rights over any personal information about you Nespresso holds and processes as a Controller .
- iii. Nespresso addresses issues related to personal data and privacy with respect and as of primary concern. In this context, we are hereby addressing you Notice in accordance with Article 13 of Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as "GDPR") to inform you about how we collect and process your personal data for the use of Mobile App.
- 2. Purpose of Processing
Nespresso, collects the necessary personal data (‘’data’’) directly from you and not from third parties, in order to enable you to use the App to collect bonus points which you will later redeem for gift vouchers. These data are kept with Nespresso as the purpose of the Mobile is to enable customers to collect bonus from purchases made as well as inform its customers for any upcoming contests, promotions and marketing purposes. Additionally, the data collected may be used to help us improve your shopping experience when using the Mobile App, to personalize your experience, to help you locate the nearest Nespresso Boutique and benefit from any promotions running, to process transactions including payment confirmation and deliver the purchased products or services requested as well as to provide customer support service.
- 3. Data Processed
Personal Data is data that can be used to directly or indirectly identify you. Personal data does not include information that has been irreversibly anonymized or aggregated so that it can no longer enable us, whether in combination with other information or otherwise, to identify you. Nespresso may retain the following necessary personal data, for the provision of services offered to you via the Mobile App:

Moreover, Nespresso shall collect data in regard to your location, only after your explicit consent in order to enable some additional features of the Mobile App providing you with information concerning
- 4. Disclosure of Personal Data
It might be necessary to share your personal data with our associates so that we could provide for you the required service such us service providers and credit reporting agencies/debt collectors.
In no case, however, are we going to share your personal data for processing for purposes contrary to those described in this Policy without your prior notification.
- 5. Security
Nespresso shall process your personal data in a manner that ensures its protection by taking all appropriate organizational and technical measures for data security and its protection against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access and any other form of illicit processing. In addition, Nespresso has taken all appropriate measures to safeguard that any partner/associate is also practicing up to date policies for the protection of personal data as per our obligations as Data Controllers, to the extent that Nespresso controls your data.
- 6. Third Party Processes
While Downloading the App you need to know that Each App Store provider (Apple App Store or Google Play) automatically processes the following data when you download our app:
6.1 the App Store username
6.2 the e-mail address entered in the App Store;
6.3 your App Store account number;
6.4 the loading time;
6.5 payment information, and
6.6 the individual device ID number.
Nespresso has no influence on this data collection and are not responsible for it. More information about the data processing in question can be found in the respective App Stores’ data protection policies:
- 7. Use of the App
Your personal data will be stored by Nespresso and due to technical reasons by the service provider of the App within Cyprus at our databases which are located at premises owned by us for the duration of your membership with Nespresso and/or for a maximum period of two years from your last purchase.
Nespresso will also use your data to provide you with information about Nespresso products, services, offers and news, provided you have already consented to that and on the legal basis of your consent (art. 6 par. 1 (a) of the GDPR).
Please note that where you have given your consent to the processing of personal information you may withdraw your consent at any time by sending an email to our Data Protection Officer (DPO). This shall not affect the lawfulness of any processing previously made on basis of your consent.
When using our app, the following information are automatically forwarded to the servers without our own action because these are technical functions Nespresso cannot alter:
7.1 the mobile terminal device from which you used our app;
7.2 the IP address of your mobile terminal device;
7.3 login date and time;
7.4 client request;
7.5 the http response code;
7.6 the volume of data transmitted, and
7.7 the version of the app you are using.
These are temporarily stored for a period of 180 days in a log for the purpose of protecting our systems, error analysis, abuse or fraud prevention as per Article 6(1)(f) of the GDPR, - for the purposes of the legitimate interest of Nespresso, i.e. for troubleshooting purposes, for addressing your complaints or for possible legal disputes. At the expiry of that period the information is deleted automatically.
- 8. Your rights
This section presents your rights with respect to your personal data. These rights are subject to certain exceptions, reservations or limitations. Please submit your requests responsibly. We will respond as soon as possible and in any case within one (1) month of receipt of the request. If the review of your request is going to take longer, you will receive relevant information.
Nespresso ensures the exercise of your rights, as provided under the GDPR, as applicable: the right to information, the right to access, the right to rectification, the right to erasure («to be forgotten»), the right to restriction of processing, the right to data portability, the right to object, the right to withdraw consent.
